Former Eastern Arizona College football player Emmanuel Livingston, 21, of South Carolina was arraigned on a single charge of aggravated assault Tues-day.

Livingston was arrested Oct. 21 after allegedly choking a teammate until he passed out and fell onto a concrete patio floor. The victim fractured his jaw when he fell, and it is currently wired shut.

Livingston’s attorney, Wendell Hughes, said his client is willing to take responsibility for what he did and that he feels remorseful.

Hughes alluded that Livingston was a 20-year-old in a grown man’s body and sometimes 20-year-olds make mistakes.

He also argued for Livingston’s release and said, due to his possible football playing future at a four-year college, he would follow all of the court’s orders to ensure he didn’t jeopardize his opportunities further.

Deputy County Attorney C. Alan Perkins said while Livingston may have an incentive to stay due to future football opportunities, he believes Livingston is no longer welcome at EAC and would have nowhere to live.

“I think that some bond or some incentive to make future appearances is appropriate,” Perkins said.

Hughes said Livingston told him he has a place to stay and that coach John O’Mera was trying to get him reinstated at school.

Judge R. Douglas Holt decided to lower Livingston’s $5,000 cash bond to a $2,000 cash bond.

“If you leave Graham County and haven’t got this cleared up, you won’t have a future in football,” Holt told Livingston, “because there will be a felony warrant out there across the country to pick you up, and you’re too big to hide.”

Holt set Livingston’s next hearing for Dec. 9 at 10 a.m.

" There is your sports programs, have to recruit people from distant locations to compete. Remember the days when players came from around the area and so did the playes at other colleges. Different world today, but guess if people are willing to pay $35 to $350 for a set to see a big sports event while the participants get paid millions....., we simply have our priorities in a cluster mess ! Why not get real, educate the people; stop spending money on small time sports programs that could be spent on techincal, medical, and upcoming career opportunities. "

" There is NO defense. He'll act out again and again until someone dies. Color has nothing to do with his actions or the community reactions. Its just what some people use to hide behind.

If his victim was another color, why isn't this a Hate Crime??? Oh I forgot, that only works one way.

EAC should be ashamed of its sports program. Once again its bringing a bad image to our valley. "

And you can tell its the same people over and over! And lets be for real how many of you even know this guy? Or his family personally to make these types of comment. These comments is just show how ignorant you all are. His family no matter what had nothing to do with it. And really and truly i hope the best for the victim and the suspect. "

College is not High School. As for the program at EAC it has always had problems form playes to coaches, yes even when Tidwell was in charge. Alot gets put to the side and no ones knows. "

As far as Livingston goes, he's from a poor family in a town in South Carolina. He has a thick accent which makes him appear to be ignorant. The judge couldn't even understand him when he said where he was from. People judge books by their cover unfortunately, and while he may be a nice guy, he looks rough. What he did to his victim, who is also black, deserves punishment. I hope he learns and can move forward. "

I am so sick of people crying about race, Those days are over............... Oh barack Obama he is half and half so now what do you have to say, who knows what else he is it's a secret. We the people know nothing about this man. except he went to Hawaii to have his records sealed. Why is that smarty pants......... Then grandma died. "

Never! Because this is an EAC athlete, this story is front page news. The truth is, this kid is a good kid that made a mistake and does not deserve to have his picture splashed on the front page like he is a murderer! There are many people trying to help him because they know him, and they aren't coaches!! "

Football is not the most important thing in this world people, its pathetic that half the students dont even get passing grades but because they're in a sport they get to slide by, or if they are choking people to almost killing them these coaches still dont care, as long as the game goes on. There should be zero tolerance for this kind of behaviour, kick him out of school,,, "
