Carjacking suspects close to accepting pleas

The punishment of those accused of assaulting, robbing and carjacking a Safford man Oct. 29 may soon be known.

According to their respective attorneys, accused carjackers Tremaine McClellan, 18, and Chi Hubert, 22, are reviewing plea agreements from the state. Both men appeared in court Jan. 6 at separate hearings.

Hubert and McClellan were arrested after being caught inside the victim’s stolen car by the Safford Police and identified by the victim as the people who beat him up. Officer Herschel Medlin followed the gold four-door Chevy Malibu through a series of turns as it drove apparently aimlessly around Safford at approximately 2:30 a.m. on Oct. 29. After Hubert parked the car in front of a residence on Third Street, Medlin approached the vehicle and asked the defendants who the car belonged to. Hubert and McClellan allegedly could not answer the question. According to Medlin’s report, Hubert later said a female named Sophia had given him the car keys and told him to take it for a drive.

The third suspect, Delphina Manuel, 22, was originally arrested with the duo but has not been charged. A gun found at the residence where Manuel was located may have been used in the commission of the crime and turned up to be stolen from Tucson.

Hubert and McClellan have been charged with a number of felonies, including aggravated assault with a deadly weapon, aggravated robbery, theft of transportation and theft of a credit card.

According to McClellan’s attorney, P. Donovan Riddle, his client has reviewed the plea agreement but has a couple of questions for Graham County Attorney Kenny Angle. Riddle said his client is favorable to the plea but would like his questions answered before signing it. He said they should be ready to move forward by next week.

Superior Court Judge R. Douglas Holt set a change-of-plea hearing for McClellan to start at 9 a.m. on Jan. 13. Holt said if there is no change in the defendant’s plea, he will set a trial date at the hearing.

Hubert’s attorney, John Brisson, said he and his client briefly went over an outline of a plea offer from Angle and would have to discuss it before moving forward. Brisson requested another pretrial conference be scheduled for Jan. 27. The date was agreed upon and set by Holt.
