Lawsuit against county may be dismissed

County Attorney Kenneth Angle anticipates that Graham County will be dropped from a lawsuit against Arizona counties that used Diebold voting machines in county and state elections.

"We just about have this dismissed," Angle told the Graham County Board of Supervisors on Dec. 21.

Alejandro Chavez is suing Secretary of State Ken Bennett and all Arizona counties because the Diebold voting machine is allegedly defective and does not generate a paper record of votes cast.



"I don't believe (the lawsuit) is anything to worry about whatsoever" because Graham has never owned or used Diebold machines, Angle said.

In the event Graham is not removed from the suit before trial, Maricopa County will defend Graham County, Angle added.

In an unrelated matter, the Board of Supervisors approved a contract with the Arizona Department of Commerce energy office for up to $190,000 spent on energy projects.

The Board of Supervisors approved an application for the Energy Efficiency Con-servation Block Grant on Nov. 16.

The EECBG will reimburse the county for up to $190,000 in expenditures to replace aging heating, ventilation and air conditioning units and lighting at the County General Services Building, the County Health Depart-ment, the Graham County Courthouse, the County Park and the County Highway Yard.

In other business, the supervisors ratified the county's voter precinct boundaries for the 2010 election cycle.

"We have made no boundary changes," County Elections Director Judy Dickerson said.

The 2010 election will include school boards, town and city governments and Arizona governor.

    " kenny don't everlet those machines in here cause thier rigged or can be without a trail this should be a no brainer. "
